Can you fly with certain drugs?

On Behalf of | Oct 28, 2022 | Drug Crimes

You know that flying is strictly controlled and that what you bring on a plane will be inspected. You certainly don’t want to get yourself in legal trouble.

But what if you have different drugs that you need to take with you on the plane? What if these are medications? Are you allowed to fly with them, or are they going to be confiscated?

You can fly with most prescription pills

If you’re talking about prescription medications, even  things like opioids that are sometimes used illegally, you generally can fly with them. One thing to keep in mind is that you want to have them in pill form, not in liquid form. Liquids are still strictly controlled on planes, so you could theoretically have a liquid container that is too large. But most medications are permissible on a plane, as long as you’re still legally using them and not sharing them with anyone else.

What about marijuana?

Marijuana has been legalized in Nevada. You can buy it for recreational use at a dispensary. This is very similar to how you can go to a liquor store and buy alcohol. You still need to be 21, there are still restrictions in place, but it is not illegal to make this purchase.

However, if you try to transport marijuana, you can run into some issues. Notably, you’re not allowed to fly with it. The federal government has still not decriminalized marijuana or made it recreationally legal.

Since it is federally illegal, you cannot cross the border from one state into another without violating these federal laws. Additionally, there is federal oversight for airports, so marijuana is still banned on the premises.

What if you just made a mistake?

People sometimes make innocent mistakes. Maybe you were going on vacation and you just forgot that you had marijuana in your bag because you don’t even think of it as a drug, but just as medicine. Or perhaps you brought prescription drugs in a form that was not permissible.

There are a lot of ways in which you could accidentally violate drug laws, especially since they’re always changing. Be sure you know about your legal defense options if you are facing charges.
